HAMLIN C. ALFORD
LAST WILL & TESTAMENT
I, Hamlin C. Alford of the County of Montgomery and State of Alabama do hereby
declare this to be my last Will &
Testament, revoking all others.
1. I desire and instruct my Executrix to pay all my just debts as soon as possible
after my death.
2. I give and bequeath unto my wife Francis E. Alford, all the property of
which I may die possessed real and personal, moneys
choes (?) in action, and rights of action to be used by her, in such manner
as she may choose, for and during the term of natural
life, and I do hereby authorize her to sell and dispose of all the property
herein devised, and to invest the proceeds according to
her own judgement--and to enjoy and use the said property or the proceeds thereof,
during her life without restriction, and
without being accountable for the same at her death.
3. I give and bequeath one half of the property or the proceeds thereof which
my wife may hold at the time of her death, and
which she obtained under the provisions of this will, to my next of kin, and
the other half, in such a manner as she may direct by
will, and in case of no such will, to her next of kin.
3. (4). I hereby appoint my said wife Frances E. Alford the Executrix of this
my last will and testament, and exempt her from
giving and bond or security as such Executrix.
I witness whereof I have hereunto set my hand and seal this seventh day of
February 1868 in the presence of Abram Martin
and P. T. Sayre.

In the matter of the Probate of the last Will and testament of Hamlin C. Alford,
deceased
Before me George Ely Judge of the Probate Court of said County of Montgomery
personally appeared in open Court P. T.
Sayre who having been by me first duly sworn and examined did and does depose
and say that he and A. Martin are each
subscribing witnesses to the foregoing instrument in writing non-shown to him,
and which purports to be the last will and
testament of Hamlin C. Alford since deceased signed and executed said instrument
on the day the same bears date and
declared the same to be his last Will and testament and that deponent and the
said A. Martin set their signatures thereto on the
day the same bears date as subscribing witnesses to the same in the presence
of said testator and at his request and in the
presence of each other.
That said testator was at the time of signing the same of sound desposing mind
memory and understanding, and in the opinion of
deponant capable of making his will at the time the same was made as aforesaid,
and deponant further States that the said
testator was on the day of the date of said will of the full age of twenty one
years and upwards.
