WILL OF JEPTHA ALFORD

In the name of God Amen I Jeptha Alford being at an advanced age but of sound
mind & disposing memory & knowing that I
must soon depart this life do make this my last will and testament hereby revoking
all others heretofore made by me.
Item 1st It is my will that my body be intered in a decent and Christian manner
& that all my debts be paid by my Executors,
immediately as there is no cause for delay.
2nd Item It is my will & desire that my beloved wife have all of my estate
both real and personal after paying my debts. So long
as she lives unmarried and at her death or marriage-- I order & direct that
all my property both real & personal be equally
divided between my two Daughters Mary Ann Driver wife of Right Driver &
Jane Phillips wife of Jacob Phillips & the heirs of
their Bodies.
3rd Item It is my will that my Daughter Elizabeth Richerson wife of James Richerson
receive at the death of my beloved Wife
Nancy Alford the Sum of five dollars in full of her distributive share of my
estate both real and personal.
4th Item The reason why I have not given Richard Alford, Guthridge Alford,
Thomas Alford & Julius Alford & Susan Jones
wife of Thomas Jones any portion of my property is that I have heretofore given
them a full share of my estate.
4th (5th) Item I hereby appoint my beloved wife Nancy Alford Executrix &
Jacob Phillips Executor to Execute this my last will
and testament in testimony whereof I have hereunto set my hand and Seal this
6th day of May 1861 --
Signed Sealed Published and declared by Jeptha Alford as his last will &
Testament in our presence who have hereunto Signed
our names to the Same at his Special instance & request This 6th of May
1861.

Carroll Court of Ordinary November Term 1869
Came into Open Court at this regular Term of the Court William M. Lyle who
being duly Sworn deposeth and saieth that he
saw Jeptha Alford sign and publish the within as his last will and Testament
while of Sound and disposing mind, that he
witnessed the same for him at his request and in his presence and in the presence
of the other two witnesses I. R. Irwin &
Kirby Lyle and that he saw I. R. Irwin & Kirby Lyle sign as witnesses. That
the same was executed by him on the day that it
purports to have been executed.

Ordered that the will be admitted to Record as Satisfactorily proven in common
form and that the Executrix Nancy Alford have
